Agreement of Site Use

By uploading and/or downloading any material to and from ArtProto.com, you agree to be bound by these terms and conditions. If you are not in compliance or in agreement with the Terms and Conditions, please discontinue the use of this site.

This agreement applies to and is intended for you and any second party on your behalf. Any use of the site's content not permitted by these Terms and Conditions are grounds for the immediate removal of any and all user names, passwords, or other authorizations that may have been granted by ArtProto.com.

ArtProto.com reserves the right to modify these Terms and Conditions at any time without further notice.

Royalty-free Concept and Usage

The royalty-free concept is the most common type of property image usage available to customers. By purchasing royalty-free images from ArtProto.com, you as the customer reserve the right to use the downloaded images however many times you want. With Royalty-free images, you are not bound by any further licenses. Your one-time payment for the royalty-free image provides you the license to use the image at your disposal in any manner you wish. There are no further royalties or licensing fees required.

Use of Images

All images found on ArtProto.com are licensed to one user to be used for your client and/or employer. All licensed images are non-transferable to other users other than the client and/or employer.

Copyrights

All contributors acknowledge that ArtProto.com excludes all images or any other material that infringes on any patent, trademark, copyright, right to privacy, right to publicity, or any other applicable law or proprietary right to be accepted.

Photograph Submission

By uploading images, all contributors are declaring that he or she owns all proprietary rights, including copyright for the images. The Contributor hereby permits ArtProto a non-exclusive license to post all images onto the ArtProto.com web site, and also allows ArtProto the right to sublicense all images to the users of ArtProto.com in agreement with the terms and conditions of Artproto.com.

ArtProto.com reserves the right to refuse and remove any and all photographs for any reason.

Model Release Agreement

All contributors of the ArtProto.com site agree to provide valid and accurate model release forms for every photograph that contains an identifiable face or identifiable human. The submission of a photograph without a model release form will not be posted to the site. All contributors of the Artproto.com are exclusively responsible for completed and accurate model release forms. Contributors who submit false or incorrect model release forms will be suspended from the site.

Use of Watermarked Images

Photographs found while browsing the ArtProto.com site include visible or electronically watermarked images. In agreement with ArtProto.com, we permit you a limited license to download images that are watermarked for your review prior to purchasing a licensed, non-watermarked image. The watermarked images are for limited, review purposes only, and may not be distributed outside of your company or client review, for public display or any other type of electronic distribution. Images downloaded from the Artproto.com site may not be sublicensed to a third party by you, and may not be purchased for use in creating your own gallery without ArtProto's consent.

Use of Non-Watermarked Images

The use of non-watermarked images can include the following uses: personal uses, magazine, journals, publications, prints, book contents, flyers, pamphlets, advertising and promotions, and/or electronically printed material including use on the web.

Refund Policy

ArtProto.com does not provide refunds or exchanges for downloaded images at any time. If an image was downloaded improperly or the image was downloaded in poor quality, you should contact the support team at ArtProto.com with an explanation of the problem due to an improper download. With a valid explanation Artproto will review your transaction details and credit your account if any errors are discovered.

Registration: Member Account, Password, and Security

After completing the registration process, it is up to the you to maintain the confidentiality of the password and account information that includes your personal information. As the user, you have the responsibility to notify ArtProto.com of any unauthorized use of your password or account or any other breach of security. As the user, you have the responsibility to exit from your account at the end of each session and close your browser for general security reasons. ArtProto.com will not take any responsibilities and will not be liable due to negligence and failure to comply with the Registration: Member Account, Password, and Security section under the Terms and Conditions of the ArtProto.com website.

Contributor Payout Policy

All contributors of the Artproto.com site will receive payment after earning (US)$50. Payments will be transferred electronically when requested by the Contributor. ArtProto sends out payments in checks, or by PayPal or electronic wire transfer to the registered author's valid bank account. The payment choices are up to the author at the time of payment.

If a Contributor cancels an account with ArtProto.com before earning the minimum payout amount ($50), the money will be forfeited with no option to receive credit for that account at a later date. Even if the contributor re-registers with a new account, this cancelled account value will no longer be available. Make sure you reach the balance and cash out your earnings before you close any account.

If in a given tax year, a contributor living in the United States earns more than $400, the Contributor must fill out a W-9 tax form provided by ArtProto.com and return it to us for further earnings payouts. The tax forms are available by e-mail or by a downloadable a PDF file from the User Account section of the site. Failure to provide a correct W-9 form will pause all payments. Filling out a W-9 tax form is a requirement of the Internal Revenue Service (IRS).

Downloading Images

As a registered user of ArtProto.com, you may download any image(s) or media file(s) according the Terms and Conditions of the site if you have credits availabe for purchase.

ALL IMAGES ON THE ARTPROTO.COM WEBSITE ARE PROVIDED ON AN "AS-IS" BASIS. WE DO NOT OFFER ANY WARRANTY FOR IMAGES, DIGITAL ARTWORK, VIDEO, OR MEDIA FOUND ON THIS SITE EXCEPT IN CASES INVOLVING NON-FUNCTIONING DOWNLOADS. ALL USERS AND CONTRIBUTORS OF THIS SITE MUST BE 18 OR OVER IN AGE.
